News Update 5th February 2016
Congratulations to all residents! You now live in the first parish in the county with an approved neighbourhood plan.
At the referendum poll yesterday residents confirmed a massive support for the parish’s Neighbourhood Plan. The declaration of the result was made late last night in the Town Hall in Hereford as follows:
39.2% of the registered electors recorded their vote.
96.4% of them said YES to the Neighbourhood Plan
YES votes - 317
NO votes - 12
It only remains for Herefordshire Council to formally adopt the Plan at a Full Council meeting. They are required to do this and adoption is considered to be just a formality. We are confident that from now on the Plan will be taken into account when planning applications are being considered.

Planning Applications
Weston under Penyard Parish Council has been invited by Herefordshire Council to comment on the two planning applications noted below. The Parish Council will discuss these matters in a public meeting at 7.30pm on Wednesday, 17th February, in the Weston village hall.

The agent for this application will make a presentation at the meeting.

News Update 15th January 2016

News Update 15th January 2016
Herefordshire Council has confirmed that polling day for the Neighbourhood Plan referendum has been arranged for Thursday 4th February. By now all eligible residents should have received official notification through the post from Herefordshire Council.
The Parish Council and Steering Group are encouraging everyone to use their vote to ensure that our plan is approved at the referendum. Voting is easy since we only have to answer Yes or No to one simple question:
Do you want Herefordshire Council to use the neighbourhood plan for Weston-under-Penyard to help it decide planning applications in the neighbourhood area?
A Yes vote will ensure we have all the benefits and protection that the Plan provides. A No vote would leave us with no protection against major housing developments, particularly around Weston village, Pontshill and Bromsash.
Please make an effort to vote on the 4th February and persuade others to do likewise. A leaflet promoting a Yes vote is being circulated and can also be found using the link below:
If the Neighbourhood Plan is approved at the referendum it will finally be adopted by Herefordshire Council as a statutory document a few weeks later.

News Update 16th December 2015
We have news of some excellent progress with the Neighbourhood Plan:
- An Independent Examiner was appointed to examine our Plan
- He quickly completed the work and issued his report on 27th November recommending that, subject to some minor amendments, the Weston under Penyard Plan should proceed to a Parish Referendum.
- Herefordshire Council agreed to the amendments and issued their formal Decision Statement today, recommending that the Plan moves forward to referendum.
Herefordshire currently has 93 areas undertaking neighbourhood plans; more than any other county in England. Weston under Penyard is the first parish in the county to successfully complete the crucial examination stage and be able to move forward to a referendum.
The referendum will be organised by the Herefordshire Council Electoral Services department in the same manner as elections. Formal notice is expected to be announced shortly for the referendum to take place in early February 2016.
Residents have played a major part in the formation of the Neighbourhood Plan and the Parish Council will be encouraging all registered residents to vote in favour of the Plan at the coming referendum. The Plan has already benefited the parish by discouraging unwanted housing developments and supporting suitable developments in acceptable locations, but the Plan will only become a powerful statutory document if a majority of residents vote to accept the Plan.
In January the Steering Group intend to issue an information leaflet and we will again be seeking volunteers to help us deliver these to all homes.

News Update 19th November 2015
Progress of the Plan
Following up on our last bulletin on 18th October we are pleased to advise that our Neighbourhood Plan seems to be progressing well again, after a few weeks pause whilst an Independent Examiner was appointed to examine our Plan. The first stage of the examination has now been completed and so far, no significant matters have been raised. We have been told that he might complete his work and issue the Examiner’s Report by early December.
We will update you again once we have the Examiner’s Report and should then be able advise on the details of the Referendum to take place in early 2016.
Herefordshire Local Plan
More good news is that the Herefordshire Local Plan (and Core Strategy) has been formally adopted. Once we get our Neighbourhood Plan adopted the two plans will sit together as statutory documents.
Approved Developments
Now that two major developments at Weston village have received outline planning permission, the developers will soon be able to commence preparation* of all the detailed plans to be submitted to Herefordshire council for approval. With our Neighbourhood Plan now having a bearing on these developments the Parish Council/Steering Group have stated that they intend to be involved in influencing the design of these developments through the application of the policies of our Plan. To this end an encouraging meeting has already been held with M F Freeman, the developers of the site adjacent to Penyard Gardens. An invitation has also been issued for a meeting to discuss the second proposed development east of Hunsdon Manor.
In parallel with the meetings with developers the Parish Council/Steering Group has also been represented in an initial meeting with Herefordshire County to consider the benefits that the parish can gain from the two developments. This will mainly concentrate on road safety improvements on the A40 and public open space enhancements. The next meeting is likely to be in January and meantime the Parish Council may wish to consider the best approach, possibly making use of the Project Groups, once established, to provide suggestions.

Some very important neighbourhood planning events have been happening over the last few weeks.
Progress of the Neighbourhood Plan
Having submitted our Plan to Herefordshire Council (HC) the second consultation phase under “Regulation 16” was completed on 16th September. HC were very quickly satisfied that the Plan should progress directly to the Examination stage. They formally announced this on 25th September in their “Progression to Examination Document”, commenting:
This Plan reads well and meets the various legal tests. The various representations are within the range of comments traditionally made on a NP of this scale and will be assessed in due course by the IE (Independent Examiner).
Weston under Penyard has now risen to third position out of the 93 Herefordshire parishes on the road to adopting a Plan.

The process is now in the hands of an independent body which supplies the IE but unfortunately it now seems that there might not be an IE available for many weeks. The parish referendum for the acceptance of the final Plan is therefore unlikely to happen until early in 2016.
Meanwhile we are advised by HC that the Plan will be used by their planning departments and applied where appropriate, even though achievement of the full legal status is a few months away.
More good news is that the Herefordshire Local Plan now seems to be reaching a final conclusion and adoption. This is important because our Plan, when adopted, can then become part of that Local Plan.
Planning Applications
At the start of September we had applications in place for three major housing developments. On 2nd September two of them, east of Hunsdon Manor and east of Penyard Gardens, received outline planning permission for up to 37 houses and 35 houses respectively. The third, in the grounds of Penyard House, was withdrawn by the applicant. The Neighbourhood Plan does not support development of this site and we understand that this fact had a significant bearing on the decision to withdraw.
What is the Parish Council achieving through the Plan?
72 new homes have been approved for construction between now and 2031. This is not what most residents wanted, but the Neighbourhood Plan has to be considered in its full context which encompasses the following achievements.
Achievements:
- The Parish Council is making rapid progress to have a Neighbourhood Plan in place. Without a Plan we would have little or no influence to prevent hundreds of new houses being built on numerous random sites throughout the parish, particularly around Weston village.
- Since the start of this year there have been three major planning applications for a total of 142 houses. The emerging Neighbourhood Plan has had a major influence in reducing this number to a maximum of 72 houses.
- The two development sites preferred by residents and proposed in the Plan have now been approved by Herefordshire Council.
- The Weston Village settlement boundary has been redrawn and no other major developments will be considered outside of that boundary.
- In the case of the two approved planning applications, it should be noted that the approval has only been granted for the number of houses and the access arrangements onto the A40. The developers still have to submit proposals for the many outstanding detailed matters including site layout, appearance of the houses and landscaping. Our Plan contains scores of policy items relevant to these detailed matters and this creates the opportunity to work with the developers and the Planning Department to achieve the highest possible standards for the new housing developments.
- In addition to the policies the Neighbourhood Plan provides for projects to be undertaken by the community (See below).
- The process of creating a Plan has involved the whole community and has greatly stimulated an interest in the future of the parish.
Projects
Neighbourhood planning Policies can only influence development that requires a planning application. However the consultations with residents produced many other concerns which can be addressed through the Projects contained in the Plan.
To develop these projects the Parish Council will need parishioners to participate in working groups.

The Parish Council is asking parishioners to volunteer to work with the Parish Council on the projects identified from the responses to the Launch Event of the Neighbourhood Plan and the August 2014 Questionnaires and are as follows:
- Project 1 Road Safety
- Project 2 Services and Facilities
- Project 3 Sustaining the Rural Environment
- Project 4 Community Right to Bid
A description of these Projects, including the scope and the community feedback, can be read in full in Section 11 of our Neighbourhood Plan. The scope of each project is reproduced below:
Project 1 Road Safety
- a) The Parish Council will continue to work with the parishioners to highlight and increase road safety.
- b) The Parish Council is aware of the concerns about road safety particularly regarding crossing the A40 and the speed of vehicles.
- c) They will work with the Highways Agency and Herefordshire Council to ensure development supports road safety and work with the parishioners and businesses to ensure harmony and sustainability.
- d) The Parish Council will review safety measures in the parish and evaluate options highlighted by parishioners to improve safety.
Project 2 Services and Facilities
- a) The Parish Council will work with parishioners to try to improve facilities within the village and support the continuation of the school, pub, church and recreation ground.
- b) Roads will need to be maintained and we will work with the Highways to ensure efficient repairs, including effective use of the Lengthmans Scheme.
- c) Parishioners will be invited to contribute to by bringing forward community projects.
Project 3 Sustaining the Rural Environment
- a) The Parish Council will continue to consider the impact of projects and plans on the rural environment and work with parishioners to ensure harmony between residents and businesses.
- b) When planning applications are considered the Parish Council will review the opportunities to develop recreation and open spaces with the plans and make suggestions as appropriate.
- c) Development opportunities will be encouraged to consider minimising impact on the views and vistas within the parish.
Project 4 - Community Right to Bid
The Parish Council will consider any properties or areas of land to be identified as assets of community value for possible Right to Bid activity (under the Localism Act 2011) and will apply to Herefordshire Council for registration of such assets if it is considered appropriate.

Our Neighbourhood Plan is continuing through the Regulation 16 consultation stage which closes on 16th September 2015. Meanwhile it is now confirmed that the planning applications relating to our two selected sites will go before the Herefordshire Council Planning Committee on 2nd September (10:00am at The Shirehall, St Peters Square).

150888 - LAND TO THE WEST OF A40, WESTON-UNDER-PENYARD, HEREFORDSHIRE. Outline application for proposed erection of (up to) 35 dwellings with new access and associated landscaping and parking.
In a written representation Weston under Penyard Parish Council objected to this application due to the size of the development, stating that it is not consistent with the emerging Neighbourhood Plan and highlighting that Policy HS1 states that the approved maximum number of dwellings on this site is now 18.
The officers are recommending approval of the application for the requested number of 35 dwellings. The Parish Council intend to speak at the meeting, but it is considered that it will be very challenging to overturn the recommendation being made by the officers.
If the application is approved then the “reserved matters” such as appearance, landscaping and layout will be dealt with at a later stage. At that time it is hoped that the Neighbourhood Plan will have progressed sufficiently so that it will have influence on these important matters.
143842 - LAND TO THE NORTH OF THE A40, EAST OF HUNSDON MANOR, WESTON-UNDER-PENYARD, ROSS-ON-WYE, HEREFORDSHIRE. Outline application for 37 dwellings (13 of which would be affordable) with all matters except access reserved for future consideration.
For this application, Weston under Penyard Parish Council has advised HC that it no longer objects to the amended proposal for 37 dwellings, stating that Policy HS2 provides for a maximum number of dwellings on this site of 37.
The officers are recommending approval of the application for the requested number of 37 dwellings. The Parish Council intend to speak at the meeting and it is anticipated that, unless there are any further strong representations of objection, the application will be approved.
If the application is approved then the “reserved matters” such as appearance, landscaping and layout will be dealt with at a later stage. At that time it is hoped that the Neighbourhood Plan will have progressed sufficiently so that it will have influence on these important matters.
Other Applications
Outside our parish it is interesting to see that on the same agenda the officers are also recommending approval of an application for 38 dwellings on a site adjacent to the B4222 in Lea. This brings the total to 110 dwellings on these three sites being recommended for approval in the same meeting.

News Update 7th August 2015
The Neighbourhood Plan (the “Plan”) continues to move on apace. Following the recent public consultation the final submission Plan was revised very slightly, unanimously approved by the Parish Council on 23rd July and then sent to Herefordshire Council on 30th July; this being the stage known as Regulation 15 . Herefordshire Council has now moved this along to Regulation 16, which is another six-week phase of publication, terminating on 16th September. Any representations received will have to be considered and unless these are very significant we still have the option to make minor changes as we proceed.
The Parish Council has expressed their thanks to everyone involved in reaching Regulation 15 stage so quickly. It is interesting to note that there are 91 neighbourhood plans currently being prepared in Herefordshire, but in terms of progress made, Weston under Penyard is in joint fifth position.
Looking forward, the final remaining stages of the Plan are the Examination and then, all being well, the parish referendum to confirm that a majority of residents agree to put the Plan in place as a fully legal document. The Plan has been written in compliance with the Herefordshire Council (HC) Core Strategy, which is essential so that the plan is accepted and becomes part of that strategy, in respect of our parish.
A key essential element is that the plan provides for a minimum of 55 additional houses between now and 2031. It is recognised that most residents would have preferred fewer houses but the only other alternative would have been not to have a Plan, in which case we would have no control at all over the future development of the parish in terms of the number of houses, where they would be built and what they would look like. The final submission Plan allows for two sites to be developed, 37 houses on site WNP08, north of the A40 near to Hunsdon Manor and 18 houses on site WNP33, south of the A40 adjacent to Penyard Gardens. The Weston village Settlement Boundary has been redrawn to include these sites, to the exclusion of any other sites (some infill may be permitted).

Having now entered Regulation 16, the Plan starts to have some weight in influencing planning decisions. The actual extent of this influence is hard to predict but, with three major planning applications already submitted by developers, we trust the Planning Committees will not ignore the wishes of the parish, as expressed through the Plan.
On each on these three specific planning applications the Parish Council has already written to Herefordshire Council to confirm that the final Neighbourhood Plan has been formally submitted. The PC has requested that all of the Plan’s policies be taken into consideration, in order that any future development in the parish is carried out in accordance with the wishes of the parish residents, as expressed through the Plan.
It may be helpful to summarise the status of these three major applications:

- It is very encouraging to note that this application has recently been amended to reduce the number of houses to 37 - thereby lining up with our Plan.
- This revision has resulted in a new consultation period through to 27th August. Any comments submitted which support the Neighbourhood Plan can only help to emphasise to the planning committee that we want them to adhere to all aspects of the Plan (not just the number of houses).
- This application will not come before a planning committee until September or even October.

News Update 17th July 2015
Our Regulation 14 consultation phase, which concluded on 7th July, went exactly to plan. We received 54 representations and over 200 individual comments. The Plan has been well appreciated and generally supported by all but a few. The Steering Group has been working flat out to review all comments, prepare responses and amend the Plan accordingly. In addition two more rather large documents have been written, namely the Consultation Statement and the Basic Conditions Statement. These are statutory requirements to demonstrate that the Plan is based on adequate evidence from the many forms of consultation and that it complies with national regulations and the HC Core Strategy.
All these documents have been formally recommended and submitted to the Parish Council today in preparation for an extraordinary Parish Council Meeting next Thursday 23rd July (Village Hall 7:30 pm). Subject to approval at that meeting the documents will then be formally deposited with Herefordshire Council (Regulation 15 phase). During the following 14 days HC will then publicise all documents for a further period of six weeks (Regulation 16).
The PC meeting on the 23rd July is a public meeting as usual and all are welcome.

Please be advised that there are important items on the agenda for the Parish Council’s meeting next Monday and you may wish to attend. 11th May 2015 at 7.30pm at Weston Village Hall.
The draft Neighbourhood Plan is ready to be published for Consultation on 25th May and so on Monday the Steering Group will be requesting approval from the Parish Council to proceed. It is very important that we get this agreed because any delay will further reduce our chances of influencing the surge in applications for housing developments.
On the agenda again will be the two ongoing housing applications near Hunsdon Manor and adjacent to Penyard Gardens, since both applicants have resubmitted their proposals with a reduced number of houses. However the numbers are still far in excess of those proposed in the draft Neighbourhood Plan and so the Steering Group has strongly recommended the Parish Council to reject both proposals outright.
Mike Dawson is the only member of the Steering Group able to attend the Parish Council meeting on Monday and so your attendance would be appreciated if you are available.
News Update 19th April 2015
Some of you may be aware that Herefordshire Council has had an issue with their draft Core Strategy (HCS) and in particular, the details of how it meets the target to provide its stated county target of 5,300 new rural houses during the life of their Local Plan up to 2031. i.e. the five-year land supply. This problem came to light during the examination of their draft HCS in February this year. It has taken some time for them to revise the HCS and to provide clear advice on how it affects the various parishes, but finally this advice was issued on Friday 17th April 2015 in an email from the HC Neighbourhood Planning Team.
One effect of these changes to the HCS is to increase considerably the number of houses to be built in the rural parishes. In the case of Weston under Penyard we had been working with a figure of 36 new houses for our Neighbourhood Plan (the Plan). Our Plan will now be required to increase this to 65 houses. In practice this can be reduced slightly since HC have also now advised that we can include within our Plan ten houses that are already built or have permission approved. This means that we will amend the draft Plan to provide a total of 55 houses through to 2031. It should be noted that in our Plan this has to be the minimum number.
One other detail that has been confirmed is that the new houses do not have to be distributed across our two main settlements of Weston and Pontshill. We can plan for them to be built at either or both of those locations. A very important part of the HCS is that new houses provided within the Plan must be built where the existing settlements are (Weston and Pontshill) and not in various other areas outside in the countryside. This doesn’t rule out the possibility of permissions being granted for houses outside the two settlements but they would not form part of the Plan.
The increase in the number of houses in the Plan may not be popular with many people but our Plan has to be compatible with the HCS and therefore it must provide for at least the prescribed numbers of houses.
Unfortunately HC’s revisions are going to result in some delay to the production of our Plan. On the 13th April 2015 we presented the draft Plan to the Parish Council and it was generally well received. The Steering Group has already considered the details of how our Plan will be affected by these changes and some amendments will soon be made with a view to gaining approval at the next Parish Council meeting on 11th May 2015. Please be assured that the Parish Council are not making commitments without your involvement. They are only being asked to approve a draft Plan for consultation with residents and other stakeholders. Although delayed by a few weeks we hope to make the draft Plan available to everyone in May and will then start the consultation process properly.
Finally some comments on the two outline planning applications involving significant numbers of houses:
Land adjacent to Hunsdon Manor Gardens. Ref. P143842/O
We are hoping at least that if the site is approved it will be for numbers much less than the 75 proposed.
Land Adjacent to Penyard Gardens. Ref. P150888/O
At the Parish Council public meeting on 13th April the recommendation from the Steering Group to the Parish Council was that the application should be “Refused on the basis that the number of houses proposed is excessive”

News Update 6th February 2015
On the 5th February 2015 a public meeting was held with the Parish Council to discuss planning application P143842/O - For up to 75 houses on land to the north of the A40, East of Hunsdon Gardens.
The Steering Group have provided their comments in writing to the Parish Council and these can be accessed below. At the meeting the parish council decided unanimously not to support this application.

Information from Village hall “drop-in” event
This event was very successfully with many residents attending to study and discuss the results of the questionnaire surveys and the progress towards the creation of our Neighbourhood Plan.

On display were:
- The survey results from the Residents’,
- Business and Housing Needs questionnaires
- First draft of the Vision and Objectives for the Neighbourhood Plan
- Ideas on settlement boundaries for Weston, Pontshill and Bromsash
- Initial drafts of Policies which will be at the core of the Neighbourhood Plan
